DMV Employer Pull Notice Program
1.0 Purpose - The purpose of the DMV Pull Notice Program is to enable employers to readily identify drivers/operators:
A. who accrue citations;
B. who accumulate a succession of citations ultimately leading up to a negligent operator designation;
C. who have been convicted of infraction(s); and
D. whose license has been restricted, suspended and/or revoked.
The DMV Pull Notice System gives an employer the opportunity to,
A. isolate problem drivers as priorities for remedial training and/or administrative action;
B. comply with existing new laws;
C. determine and evaluate statistical trends for corrective action: and
D. take proactive measures to reduce potential accidents and/or losses.
2.0 Confidentiality
2.1 Public Record - The California Vehicle Code, section 1808 provides in part:
"...With a few minor exceptions all records of the Department of Motor Vehicles relating to registration of vehicles, information contained on applications for drivers licenses, abstracts of convictions and accident reports are public records and open for inspection." (emphasis added)
2.2 DMV Reports - The District Risk Manager shall be the contact person and custodian of the DMV Pull Notice records. The records will be stored in a locked file cabinet inside the private office of the Risk Manager. This office is protected by an alarm system during the evening and weekend hours. These records shall be considered confidential and shall be reviewed pursuant to section 4.3 of this procedure. These records will not become part of the employee employment record. However, upon the request of the District Auto/Liability Insurance carrier, the District will provide the carrier with a list of the names and drivers license numbers of all drivers who drive District vehicles.
3.0 Positions included in the DMV Pull Program -
A. Employees required to have a Class A or Class B drivers license as part of their job, see Attachment A for a list of these positions;
B. Employees required to drive District vehicles, see Attachment B for a list of these positions;
C. Employees required to have a valid drivers license as part of their job description; see Attachment C for a list of these positions.
4.0 Procedure -
4.1 Current Employees - All employees listed in section 3.0 who were hired prior to July 1, 1992 will be required to participate in the DMV Pull Program. Managers and Supervisors will fill out DMV form INF 1103 with names and drivers license numbers of the appropriate employees within their areas of responsibility. The Manager/Supervisor will return the completed form to the Risk Manager. The Risk Manager will then add the Confidential Requester Code number and contact person name. The DMV INF 1103 form will be submitted to the Sacramento DMV office.
4.2 New Employees - Employees listed in classifications in section 3.0 hired on or after July 1, 1992 will be required to participate in the DMV Pull Program and will receive their DMV form INF 254 as part of the District employment packet. The form will then be submitted to the Risk Manager. The Risk Manager will then add the Confidential Requester Code number and contact person name. The DMV INF 254 form will be submitted to-the Sacramento DMV office.
4.3 Consequences of the DMV Report - Once the Risk Manager receives a report from DMV, the following action will be taken:
a. Notice of Conviction(s) of driving offenses - to be reviewed by the Risk Manager on a case by case basis.
b. Notice of an accumulation of a negligent operator's record conference with employee, Manager/Supervisor and Risk Manager to discuss seriousness of offense and appropriate action to be taken.
c. Notice of driver's license suspensions or revocations employee will not be allowed to drive a District vehicle or personal/private vehicle on district business or in the course and scope of their employment. If the restriction on their license interferes with their ability to meet requirements of the job, at the discretion of the District, the employee may be placed on unpaid leave, assigned other duties, transferred to another position which does not require driving a District vehicle or released from District employment if they no longer can fulfill the required qualifications for their position.
d. Notice of any other actions taken against the driving privilege or certificate - to be reviewed on a case by case basis.
These reports will be generated every six months and whenever the DMV receives conviction notice(s).
5.0 Termination/Change of Address - Employees are responsible for reporting to the Risk Manager in writing whenever they leave the employment of the District or have a Change of Address.
EMPLOYEES REQUIRED TO HAVE A CLASS A OR CLASS B LICENSE AS PART OF THEIR JOB - ATTACHMENT A
1. Drive any vehicle or combination of vehicles with a gross vehicle weight rating of 26,001 lbs., or more. This includes fire fighting equipment.
2. Tow a trailer with a gross vehicle weight (GVW) of 6,000 lbs. or more.
3. Drive a vehicle designed, used, or maintained to transport more than 10 passengers, including the driver (bus or vans).
